1. What am I entitled to if I get injured on the
job?
Workman's Compensation in Tennessee is governed by statute. There are
basically five elements of recovery for an injured worker.
- MEDICAL BENEFITS The employer must pay all medical benefits of an
employee injured on the job. Provided they were ordered by an authorized
physician.
- TEMPORARY TOTAL BENEFITS The worker is entitled to weekly compensation
in the amount of 2/3 of his average weekly salary up to a maximum
amount of $515.00 a week. This starts after the worker is unable to
work one (1) week.
- PERMANENT PARTIAL DISABILITY If a worker has a permanent physical
impairment or loss of earning capacity, he is entitled to an award
for this. This amount could be substantial and can only be determined
after you are released from the doctor or have gotten as well as you
are going to get.
- PERMANENT TOTAL DISABILITY If you are 100% unable to return to work
you can receive four hundred (400) times your weekly Workers' Compensation
payments, and in some cases even more.
- DEATH BENEFITS In the event a worker is killed on the job or dies
of injuries received on the job, he is entitled to certain benefits,
but more importantly any dependants may be entitled to benefits depending
on their dependency. This could be a very substantial amount and may
vary widely from case to case.
