Family files lawsuit alleging nursing home neglect

Residents of Tennessee will likely agree that their children and their elders are the most vulnerable citizens, and jeopardizing the safety of these loved ones is unacceptable. A senior care facility in another state is facing a lawsuit that was filed by the estate of a man who was allegedly subjected to multiple forms of nursing home neglect while he was a resident. The suit claims that the facility offered better care for more money, yet the man was still subjected to deplorable circumstances.

The complaint states that the man was a resident of the care facility from April 2013 through March 2015. The executor of the estate asserts the man was sick with the flu on March 9, 2015, and transfer to a different floor was recommended. The plaintiff alleges that better care was offered at a higher fee.

It is claimed that, despite the promise of better care, the man was found asleep and unclean. It alleges that the facility had allowed skin irritations to develop, along with cracked skin and bruising, bedsores and shoulder and arm pain. Furthermore, he was apparently found to be wearing his regular clothes while sleeping, and his room was in general disarray. The plaintiff also alleges that the care facility failed to bring his food to him.

These are only some of the alleged negligent actions contained in the court documents. The estate claims that the lack of proper care and the unhealthy conditions caused the rapid deterioration of the man’s condition just prior to his recent death. Damages in excess of $100,000, plus costs, are sought by the plaintiff.

Tennessee residents who believe that their loved ones suffered negligent care in a health care facility are entitled to pursue claims for monetary damages. An experienced personal injury attorney who focuses on protecting the rights of the elderly and their families may prove helpful. With the resources commonly available to a lawyer, evidence to substantiate a claim of nursing home neglect can be gathered for the preparation and presentation of the claims for financial relief.
